Assistance of Counsel

The Sixth Amendment ensures that all criminal defendants have the right to legal representation. This right doesn’t depend on whether or not the defendant can pay for a lawyer. If a defendant can’t pay for a lawyer, the government must give them one. The right to counsel is more than just the right to have an attorney present during a criminal trial. Effective help must be supplied by the attorney.
